I received Spouse Visa to be with my husband and to help look after him because of his health, for which he receives benefits for his survival. I am aware and concur that the terms of my visa include that I am not to draw on Public funds for my up keep. I am seeking employment and understand I shall pay my own Council tax and expect to pay my share of the rent.

My retirement fund was converted to IRA (indivdual retirement account) to be visible as a lump sum to UK Government as requirement for immigration. It is in America and not useable by me for any purpose until I am at retirement age, or I will be hit with very high taxes.

We are filling out an ESA 3 form.

How may I describe this sum on the form without harm to my husband’s benefits which, as far as I can see, should remain unchanged except for reduction of housing benefit to the sum of such contribution as I should make, and cessation of his sing’e-person’s allowance, given that he is now married.

All you can do is provide details of the account and explain any limitations that there are in accessing the monies. The DWP will then make a Decision on how they view the money and whether it will effect your husband's benefits, if it is an adverse Decision then you should be able to appeal it.

Hi J and welcome to the forum. On the assumption that you are also new to the site, this link should help you find your way around.

Welcome to Benefits and Work

Yours is a specialised issue and I think you will need to get face 2 face advice from someone who is experienced in this area. You could try your local CAB, especially if they have a benefits advisor or your could put 'welfare/benefits advice' and your postcode in to your search engine of choice.

Of course, one of the other mods might have other suggestions, in which case they will also post.
